Earth Wake will never share, sell, rent, exchange, or otherwise release your personal information to or with any third-party for financial gain or marketing purposes.  By making your personal information available to us, you grant EarthWakeFoods.com the right, subject to applicable law, to use said personal information to contact you by telephone and email regarding your use of our Site (including but not limited to any purchase of EarthWakeFoods.com products).  To cease receiving communications from us, follow the instructions at the bottom of any marketing message by clicking “Unsubscribe”. 

We may employ other companies and individuals to perform certain functions on our behalf. Examples include processing credit card and other payment transactions, sending direct and electronic mail, analyzing data and providing marketing analysis. Online Purchases

EarthWakeFoods.com utilizes third-party service providers to process credit and debit card payments.  If you decide to purchase EarthWakeFoods.com products, the credit or debit card information used in the transaction will be shared with our contracted third-party payment processing service provider(s).  We require that our third-party payment processing providers have privacy policies and practices consistent with this Privacy Policy during all times that they are providing such services to us; however, we cannot guarantee the privacy practices of any third-party service provider.

Security of Personal Information

We endeavor to safeguard and protect our Users' personal information. When Users make personal information available to us, their personal information is protected. Where our process prompts Users to enter Sensitive Information (such as credit card information), and when we store and transmit such Sensitive Information, that information is transmitted securely with advanced TLS (Transport Layer Security) encryption. We do not store credit card numbers; our processor “Shopify Payments” may store your card details including your card number for transaction purposes.

Access to your personal information is strictly limited, and we take reasonable security measures to ensure that your personal information is not accessible to the public.

This data is shared with Facebook (Meta) and other third parties for retargeting and advertising purposes. You have the right to object to the use of the Facebook Pixel and other tracking methods. Earth Wake reserves the right to change or update this Privacy Policy at any time by posting a notice on the Site that we are changing our Privacy Policy. If the manner in which we use personal information changes, we will notify Users by: (a) posting the updated Policy on this page with any significant changes noted at the top of this page; (b) sending the modified policy to our Users via e-mail; and/or (c) by any other reasonable means acceptable under applicable state and federal law. California Privacy Notice – California Residents

The California Consumer Privacy Act (“CCPA”) grants certain rights to California residents with regard to “Personal Information” (as defined by CCPA) and places certain obligations on us.  CCPA requires that you have a right to know about the information we have and a right to have us delete your Personal Information.  This California Privacy Notice applies only to California residents and is supplemental to the Privacy Policy.  If you are a California resident, please review the following information regarding our collection, use, and handling of your Personal Information.

Right to Know

California residents have a right to know: (a) the categories and specific pieces of Personal Information that Earth Wake has collected, (b) the sources of the Personal Information, (c) the categories of Personal Information Earth Wake sells or shares with third parties (other than service providers) for business purposes including the categories of recipients of your Personal Information; and (d) the business or commercial purpose of Earth Wake’s collection or disclosure of Personal Information.

Right to Delete

California residents have the right to request Earth Wake to delete their Personal Information that we collected from the California resident by submitting a written and verifiable request.

2. Your address
3. Your phone number and email address
4. Your request for Earth Wake to:
1. Disclose what Personal Information is collected,
2. Delete your Personal Information, an/or
3. Provide an accounting or report of your personal information
5. Signature

CCPA requests will be complete within 45 days of receipt of a written and verifiable consumer request (Civil Code §1798.130).  Pursuant to CCPA, Earth Wake is not requested to provide Personal Information to a California resident more than two times in a twelve (12) month period.  If your request is incomplete, you will be notified by mail and your request will not be considered until a complete written and verifiable request is received.  Verifiable requests apply only to records maintained by Earth Wake.  

We may verify requests a variety of ways depending on the nature of the request.

We may deny your deletion request if retaining the information is essential to:

1. Complete the transaction for which the personal information was provided and collected, provide a product that you requested, or otherwise carry out our obligations in connection with our contract with you;
2. Detect security incidents, protect against malicious, deceptive, fraudulent or illegal activity or prosecute those responsible for such activities; or
3. Comply with a legal obligation.

California residents have the right not to be subject to discriminatory treatment by Earth Wake for exercising their privacy rights under CCPA, and Earth Wake will not discriminate on that basis.  Earth Wake is committed to upholding its obligations under CCPA.
